These Terms of Service ("Terms") govern your use of LeadMachineAI ("Service"), operated by LeadMachineAI ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. Please read them carefully.

1. The Service

LeadMachineAI provides an AI-powered chat widget and lead capture system for local service businesses. The Service allows businesses to deploy an AI assistant on their website that responds to visitor questions and captures contact information.

2. AI Disclosure

The chat widget uses artificial intelligence (powered by OpenAI) to generate responses. By using this Service:

• You acknowledge that responses are generated by AI, not a human.
• You agree to accurately configure your business profile so the AI provides correct information to your customers.
• You understand that AI responses may occasionally be inaccurate or incomplete, and you take responsibility for reviewing and following up on captured leads.
• You agree not to configure the AI to make false, misleading, or deceptive statements to visitors.

3. Your Account

You are responsible for maintaining the confidentiality of your access code and for all activity under your account. You must provide accurate information when creating your account. You may not share your access code with unauthorized parties or use the Service on behalf of others without their knowledge.

4. Acceptable Use

You agree not to use the Service to:

• Provide false or misleading information to website visitors
• Collect visitor data without appropriate notice on your own website
• Violate any applicable local, state, or federal laws or regulations
• Spam or harass individuals whose contact information was captured
• Attempt to reverse engineer, copy, or resell the Service

5. Your Responsibilities as a Business Client

You are responsible for:

• Ensuring your own website has an appropriate privacy notice informing visitors that an AI chat tool is in use and that their data may be collected
• Handling captured lead data in compliance with applicable privacy laws
• The accuracy of the business information you provide to configure the AI
• Following up with leads in a professional and lawful manner

6. No Guarantee of Results

We do not guarantee any specific number of leads, conversations, or business outcomes from using the Service. Results vary depending on your website traffic, business type, how the AI is configured, and other factors outside our control.

7. Pricing and Billing

During the current beta period, the Service is provided free of charge. When paid plans are introduced, you will be notified in advance. Continued use after pricing is introduced constitutes acceptance of the applicable fees. All fees are non-refundable unless otherwise stated.

8. Limitation of Liability

To the maximum extent permitted by law, LeadMachineAI shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to lost profits, lost leads, or business interruption. Our total liability to you for any claim shall not exceed the amount you paid us in the three months prior to the claim.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that AI responses will always be accurate or appropriate for your specific situation.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or use the Service in a way that is harmful to us, other users, or website visitors. You may cancel your account at any time by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. We will notify active clients of significant changes. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in a court of competent jurisdiction.
